These Terms of Use apply to the use of the Podcastify App (hereinafter referred to as "App"), provided by C&P Apps (hereinafter referred to as "Provider").

By installing and using the App, you agree to these Terms of Use. If you do not agree with these terms, you may not use the App.

2. Description of the Service

The App enables users to create AI-powered podcasts and audio content. Features include:

• Creation of podcasts in various formats (dialogue, solo, panel discussion, etc.)
• Selection of topics, genres, and content depth
• Customization through custom prompts and ideas
• Professional voice output with multiple AI voices
• Optional creation of accompanying videos
• Local storage of created content

3. Target Audience

The App is designed for adults who want to create professional podcast content. Users must be at least 18 years old or have parental consent to use the App.

4. User Account and Registration

Using the App does not require registration or creation of a user account. All data is stored locally on your device.

5. In-App Purchases and Subscriptions

5.1 Credits System

The App uses a virtual currency system ("Credits") to create podcasts:

• You receive free welcome credits upon first use
• You can receive free credits daily
• Additional credits can be purchased through in-app purchases
• The cost of creating a podcast varies depending on length and format

5.2 Subscriptions

The App offers subscription options that may provide the following benefits:

• Regular credit allocations
• Access to premium features
• Discounted rates

5.3 Payment Terms

• All purchases are processed through your Apple App Store account
• Prices are displayed before purchase and include applicable taxes
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Cancellation is done through your App Store account settings

5.4 Refunds

Refunds for in-app purchases are subject to Apple's policies. Requests should be directed to Apple.

6. Usage Rights and Ownership

6.1 App and Software

The App, including all content, features, and design, is protected by copyright. You are granted a non-exclusive, non-transferable right to use the App for personal purposes.

6.2 Generated Content

You may freely use the podcasts, audio files, and images created with the App for personal and non-commercial purposes. Commercial use or publication of generated content requires compliance with the terms of the underlying AI services (OpenAI, Google) and may require additional licensing.

7. User Obligations and Prohibited Use

When using the App, you agree to:

• Use the App only for lawful purposes
• Not generate content that violates applicable law
• Not request offensive, discriminatory, violence-glorifying, or otherwise inappropriate content
• Not manipulate or hack the App
• Not perform automated access to the App
• Not infringe the rights of third parties

8. Availability and Changes

8.1 Availability

We strive to keep the App and its services continuously available. However, we do not guarantee uninterrupted availability. Maintenance work, technical issues, or force majeure may lead to temporary restrictions.

8.2 Changes

We reserve the right to change, expand, or discontinue the App and its features at any time. Users will be notified of significant changes.

9. Disclaimer

9.1 Content

Generated podcasts are created by AI systems. We make no warranty for:

• The accuracy or appropriateness of generated texts
• The suitability of content for specific purposes
• The quality of generated voice or image output

9.2 Technical Functionality

Use of the App is at your own risk. We are not liable for:

• Data loss on the user's device
• Damage caused by improper use of the App
• Internet connection failures or disruptions
• Actions of AI service providers (OpenAI, Google)

9.3 Limitation of Liability

Our liability is limited to intent and gross negligence. This does not apply to damages resulting from injury to life, body, or health.

11. Third-Party Services

The App uses third-party services:

• Apple App Store: For downloading the App and processing purchases
• RevenueCat: For managing subscriptions and in-app purchases
• OpenAI: For generating texts and voice output
• Google (Gemini): For generating texts, voice output, and images

The respective terms of use and privacy policies of these providers apply to these services.

12. Termination of Use

You can terminate use of the App at any time by uninstalling it from your device. Existing subscriptions must be cancelled separately through the App Store.

We reserve the right to block access to the App if these Terms of Use are violated.

13. Changes to Terms of Use

We reserve the right to change these Terms of Use at any time. You will be informed of significant changes. Continued use of the App after changes constitutes acceptance of the modified terms.

14. Final Provisions

14.1 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

14.2 Severability Clause

Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.

14.3 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
